By deciding to approve the Base Prospectus, the CNB, in its capacity as competent authority under the Prospectus Regulation, merely certifies that the approved Base Prospectus meets the requirements of the Prospectus Regulation and the Implementing Regulation for completeness, consistency and clarity.
The decision of the CNB does not assess the quality of the Bonds which are the subject of this Base Prospectus or the quality of the Issuer. In particular, the CNB does not assess the Issuer's economic performance or financial condition and, by approving the Base Prospectus, does not guarantee the future profitability of the Issuer or its ability to repay the proceeds or the nominal value of the Bonds. Prospective investors should therefore consider for themselves the suitability of an investment in the Bonds without relying on the existence of the CNB's approval of the Base Prospectus.
Investors are advised to read the publicly available information on the product in question, such as prospectus supplements or bond terms and conditions, in detail before making any investment decision. Investing in investment instruments generally involves certain risks arising in particular from the nature of the particular investment instrument as well as from the laws and practices of the relevant financial markets or countries. Even for conservative investments, risks cannot be completely avoided, but they can be mitigated, in particular by diversification, i.e. by spreading the assets of the portfolio and by active monitoring of the development of the investment on a regular basis. If an agreement arises between DOMOPLAN a.s. as issuer of the bonds (the ‘Bonds’) or AVANT Capital a.s. as distributor of the Bonds and an investor who is a consumer within the meaning of Act No. 634/1992 Coll, Consumer Protection Act, as amended (the ‘Consumer’), a dispute at the conclusion or from the performance of the contract on subscription of the Bonds or the exercise of rights and obligations under the Bonds, the Consumer has the right to turn to the authority for out-of-court settlement of consumer disputes, which is the Czech Trade Inspection (www.coi.cz, Štěpánská 567/15, 120 00 Prague 2). However, depending on the nature of the dispute, another authority may have jurisdiction. At the Consumer's request, DOMOPLAN a.s. or AVANT Capital a.s. will inform the Consumer of the competent authority for the out-of-court settlement of the specific dispute.
